Privacy Statement

The controller EMIKO s.r.o., with registered office at Na ihrisko 580/15, 951 41 Luzianky, ID: 45595453, processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data (GDPR) and Slovak Act No. 18/2018 Coll. on Personal Data Protection.

What data do we collect?

In providing our services, we collect the following personal data:

• First and last name (or company name, ID number, VAT number and contact person)
• Address (billing and delivery)
• Phone contact
• Email address

Why do we collect this data?

We collect and process personal data for the purpose of:

• Conducting business transactions (vehicle sales)
• Communication with customers
• Processing financing and insurance requests
• Fulfilling legal obligations
• Sending marketing communications (only with consent)

Legal basis for processing

We process your personal data based on:

• Contract performance – pursuant to Art. 6(1)(b) GDPR – processing is necessary for the performance of a contract to which you are a party
• Legitimate interest – pursuant to Art. 6(1)(f) GDPR – processing is necessary for the purposes of the legitimate interests of the controller
• Consent – pursuant to Art. 6(1)(a) GDPR – for marketing purposes

Recipients of personal data

Your personal data may be provided to the following processors to the necessary extent:

• WEBPAGE s.r.o. – web services provider
• VUB Leasing – financing intermediary
• Home Credit Slovakia, a.s. – financing intermediary
• SENTIA s.r.o. – insurance intermediary
• Accounting and legal office

Transfers of personal data to third countries

While operating the website, we use services that may result in the transfer of personal data (in particular IP addresses, device identifiers and on-site behavioural data) outside the European Economic Area:

• Google Analytics — operated by Google LLC (USA). Transfers take place under the European Commission adequacy decision 2023/1795 (EU–US Data Privacy Framework). Google is a certified participant in the framework.

Other transfers outside the EU/EEA are only made where the country has an adequacy decision under Art. 45 GDPR or on the basis of the standard contractual clauses under Art. 46 GDPR. Transfers to Google Analytics only take place if you have granted consent to analytics cookies.

Data retention period

We retain personal data for the period of:

• 15 years from the end of the contractual relationship – for the purposes of fulfilling contractual and legal obligations
• 5 years from granting consent – for marketing purposes (or until consent is withdrawn)

Your rights

In connection with the processing of your personal data, you have the following rights:

• Right of access – you have the right to obtain confirmation as to whether your personal data is being processed
• Right to rectification – you have the right to have inaccurate personal data corrected
• Right to erasure – you have the right to request the deletion of your personal data
• Right to restriction of processing – you have the right to request restriction of processing
• Right to data portability – you have the right to receive personal data in a structured format
• Right to object – you have the right to object to processing based on legitimate interest
• Right to withdraw consent – if processing is based on consent, you have the right to withdraw it at any time
• Right to lodge a complaint – you have the right to lodge a complaint with the Office for Personal Data Protection of the Slovak Republic

Automated decision-making and profiling

We do not carry out automated individual decision-making, including profiling, within the meaning of Art. 22 GDPR that produces legal effects for you or similarly significantly affects you. All decisions within vehicle sales, financing or insurance are made by a natural person.

Security measures

To protect your personal data, we use the following technical and organizational measures:

• Encrypted access to systems (SSL/TLS)
• Encryption of passwords and sensitive data
• Regular system updates
• Regular data backup
• Access limited to authorized employees only
